Challenge to Ministers’ Federal Tax Exemption Likely to Fail, Witte Says
A lawsuit brought by a Madison, Wis., tax fairness group that targets ministers’ federal exemption for housing is likely to fail as other similar efforts have, said John Witte, Emory Law’s Jonas Robitscher Professor of Law, Alonzo L. McDonald Distinguished Professor, and director of the Center for the Study of Law and Religion. Witte was quoted in a story in the Wisconsin State Journal about the lawsuit, filed Tuesday in U.S. District Court by the Madison-based Freedom From Religion Foundation.
"I think the Supreme Court has made it clear that tax exemption cases are for the legislature, not for the courts, to decide," Witte said.
