Nash Critiques Judicial Review in Financial Reform Proposal
In a National Law Journal op-ed, Professor Jonathan Nash and co-author University of Washington Professor Rafael Pardo critique the judicial review structure of the resolution authority provisions of the financial reform proposal currently being considered by Congress. Nash and Pardo argue that the Senate version of the proposal provides for insufficiently broad judicial review, and thus leaves executive power to liquidate financial companies largely unchecked.
